Terms & Conditions
The following terms and conditions are set out in order to avoid any misunderstandings regarding all bookings, Cadbury House is referred to as “The Company” and the Person, Firm or Company making the booking, including their guests, is referred to as “The Customer”. Deposit and/or written confirmation of the booking from the Customer and/or a signed copy of this document implies acceptance of these Terms and Conditions.
1, Deposits and Payments - DEPOSITS ARE NON REFUNDABLE
The Company reserves the right to require payment of a deposit at any time prior to the holding of a function. Should the customer fail to pay such a deposit within 7 days of being requested to do so the Company may treat the booking as having been cancelled by the customer. The balance shall be required no later than 1 month prior to the event or on the date set by the Company. In view of the high costs of financing, interest will be charged at a rate of 5% per month on amounts remaining unpaid at the due date.Wedding Receptions - £1000 deposit with booking. A further 50% of estimated balance 6 months prior, remaining estimated balance 1 month prior.Dinner Dances/Functions - £350 deposit with booking. A further 50% of estimated balance 6 months prior, remaining estimated balance 1 month prior.Any Miscellaneous charges must be paid prior to departure from hotel.1a, Direct Billing – The Customer may request direct billing, a credit request must be completed and returned to the Company at least 21 days prior to the event. With credit approval by the Company, the hotel will open a client account, to which all authorised charges will be billed directly. Credit facilities will only be extended to approved account holders.
2, Confirmation – A non-refundable deposit of the amount stated is required at booking.
Hotels final confirmation of details if the number of persons attending reduced by 10% or more from the original number guaranteed, the hotel reserves the right to be able to change the booking to a different suite as best fits the numbers involved. For all 8 and 24 hour packages the Company will charge for a minimum of 8 delegates, however, the Company reserves the right to split this down to a room hire charge and meals taken if numbers drop below 8.
3, Re-confirmation - The customer shall notify Cadbury not less than 14 days prior to the function the anticipated number of guests attending.
The final numbers shall be notified in writing not less than 7 days prior to the function. If a customer booking is accepted by the Company on the basis that a minimum number of persons will attend the function for which the booking is made, the amount payable by the customer shall be calculated on such minimum number or the number actually attending, whichever is the greater.
4, Cancellation General Points
In the event of cancellation of any booking or non-arrival by a customer, the customer shall pay to the Company a cancellation/non-arrival fee. However, the Company will do its utmost to release t the space, but if, having used their best endeavours, the Company are unable to do so, the following cancellation charges will apply4a, Cancellations by the customer – All cancellations must be in writing by registered postCancellation of event or reduction in numbers for accommodation and conferences.Our cancellation terms oblige you to pay the Company a percentage of the total anticipated charges as follows:Cancellation between 3 & 6 months prior to the event – 25%Cancellation between 1 & 3 months prior to the event – 50%Cancellation up to 28 days prior to the event – 100%Wedding Receptions, Lunch, Dinner, Dinner Dances – 100% of anticipated revenue if cancelled less than 6 months before arrival.
5, Cancellation by the Company
The Company may cancel the booking under the following circumstances: a) if Cadbury or any part of it is closed due to circumstances outside it’s control, b) if the Customer becomes insolvent or enters into liquidation or receivership, c) if the Customer is more than 14 days in arrears with any payments to the Company, d) if the booking might prejudice the reputation of or cause damage to Cadbury – In such events the Company will refund any advance payments made but will have no further liability to the customer.
6, Christmas Bookings
A non-refundable deposit of £10 per person (£20 per person for New Years Eve) is required to confirm the number of places required within 14 days of initial booking. If numbers in the party are reduced, those deposits cannot be used for any balance of payment. The full balance of payment is required no later than a pre-specified date in November, All monies paid are non-refundable. Cadbury House cannot be held liable for financial loss due to any accident/illness incurred prior to the event, and cannot act as an agent for Insurance provision.
7, Hotel Room Bookings
Any cancellations taken less than 72 hours prior to the date of arrival, will be charged at the full balance of the stay.For group bookings (10 people or more) please see terms and conditions no.4aFor Accommodation Allotments the Company is under no obligation to inform the Customer when releasing all bedrooms held that are not reserved and guaranteed by the schedule release date which is normally 1 month prior. The company reserves the right to amend schedule release dates to 2 or 3 months prior depending on the number of bedrooms held.
8, General Liability
The Company will not be liable for any failure to provide the services contracted in the following circumstances:A. Industrial action taken by the Company employees, Industrial action taken by staff of a major supplier, Fire, lightening, aircraft impact, explosion, riot and civil commotion, malicious damage, storm, tempest, flood, burst pipes, earthquake and impact, Postal bookings that do nor reach them, Breakdown of plant or any failure to supply to Cadbury of gas, electricity, water services etc, Any other circumstances beyond their reasonable controlWithout prejudice to the foregoing and without incurring any liability against them the Company undertake to take all possible action to alleviate any such inconvenience.A. This contract shall not be assignable by the customer, but may be assigned by the Company.B. This contract shall be governed by and construed in all aspects in accordance with the laws of the country in which the Club for which the booking is made is situated.
9, 3rd Party Personal Insurance
The Company shall not be held responsible for the death or bodily injury arising from any cause other than negligence on the part of Cadbury House or it’s employees acting solely within the cause of their employment, to persons employed by the hirer during the period of hire whether such death or injury occurs within the allocated rooms or in any part of the Club.
10, Cloaks and Personal Property
The Company does not accept responsibility for the property of customers. Cloakrooms are provided for the convenience of customers but any goods deposited in the cloakroom are deposited at the owners’ risk and without any obligation on the part of the Company. The Company does not accept liability for loss or damage to any item of equipment, furniture, stock or the like belonging to the customer.
11, Car Parking
Cars parked on the premises or within the grounds of Cadbury House are parked entirely at the owner’s risk and Cadbury disclaims any liability for any damage to customers’ vehicles howsoever sustained.
The customer shall be responsible for any damage caused to the allocated rooms or the furnishings, utensils and equipment therein by any act, default or neglect of the customer, and shall pay to the Company on demand the amount to make good or remedy any such damage.
No wines or spirits may be brought into the allocated rooms by customers for consumption on the premises.
14, New Licensing Act
Under the new licensing act anyone who looks under the age of 21 years will be asked to show identification, accepted ID; 1, driving license, 2, passport, 3, Portman Group Card). Failure to do so will result in the refusal of service of alcohol.All bookings made arising out of this Agreement will be deemed subject to the above Conditions which will prevail over any Conditions stipulated or referred to by the Customer. The agreement does not affect any rights which the Customer may have under their statutory rights.
